Developer: Surge LTC ("Licensor")

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE INSTALLING OR USING THE SOFTWARE. By installing, copying, or otherwise using Surge Optimizer, you ("User") agree to be bound by the terms of this End User License Agreement ("Agreement"). If you do not agree to the terms, do not install or use the Software.

1. License Grant

Surge LTC grants you a limited, non-exclusive, non-transferable, and revocable license to install and use the Software for personal, non-commercial purposes on devices you own or control.

2. Prohibited Actions

• Share, distribute, sublicense, sell, or publicly disclose any product keys or license information, including for Surge Plus or any other version of Surge Optimizer.
• Use shared, leaked, or pirated license keys to activate the Software.
• Reverse engineer, decompile, disassemble, or modify the Software.
• Circumvent or tamper with any licensing, activation, or digital rights management mechanisms.
• Use the Software in any way that violates laws or infringes on any third-party rights.

3. System Modifications

The Software may apply system-level optimizations and configurations that alter the default behavior of Windows operating system features, services, or registry settings. It is your responsibility to review all changes before applying them. Surge LTC is not responsible for unintended side effects of such changes.

4. Data Collection and Privacy

Surge LTC is committed to protecting the integrity of its licensing system. To enforce license compliance and prevent unauthorized use, the Software may collect and transmit certain technical and diagnostic information, including but not limited to:

• IP addresses
• Hardware identifiers (e.g., CPU ID, motherboard ID, system UUID)
• License keys and activation status
• Software usage metrics and environment data

This information is used solely for the purposes of fraud prevention, license enforcement, analytics, and improving Software functionality. No personally identifiable information (PII) is collected unless explicitly provided by the User.

By using the Software, you consent to the collection and processing of such data as described. Data may be stored securely on Surge LTC's servers and will not be sold or shared with third parties except as required by law or to protect Surge LTC’s legal rights.

5. Automatic Updates

The Software may periodically check for updates and download them automatically. You agree to receive such updates, which are intended to improve, enhance, and further develop the Software, including bug fixes, security patches, new features, and modifications.

6. Termination

This Agreement is effective until terminated. Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and uninstall it from all devices.

7. No Warranty or Responsibility

Surge LTC provides this Software "AS IS" and makes no warranties of any kind, express or implied. This includes but is not limited to warranties of fitness for a particular purpose or non-infringement.

By using this Software, you acknowledge and accept that:

• Tweaks applied through Surge Optimizer may modify system settings or behavior.
• Surge LTC is not responsible for any damage, data loss, performance issues, or system failuresresulting from the use of the Software or its features.
• You use the Software entirely at your own risk.

8. Ownership and Intellectual Property

All rights, title, and interest in and to the Software (including all intellectual property rights) are and shall remain the exclusive property of Surge LTC. This Agreement does not grant you any ownership rights.

9. Governing Law

This Agreement shall be governed and construed in accordance with the laws of the jurisdiction in which Surge LTC is headquartered, without regard to its conflict of law provisions.
